Terms of Service
1. Acceptance of Terms
Welcome to Mayland. By downloading, accessing, or using the Mayland application, website, or any associated services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Platform.
2. Eligibility and User Accounts
- Age Requirement: You must be at least 18 years old to create an account and use this Platform. By registering, you warrant that you are legally capable of entering into binding contracts.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
- Trust Points & Verification: To maintain a secure environment, Mayland utilizes a "Trust Points" system. Users may voluntarily submit verification documents to earn trust badges. Falsifying documents or impersonating another individual is grounds for immediate, permanent account deletion.
3. Nature of the Platform (Venue Disclaimer)
Mayland operates as a free, zero-fee community infrastructure platform providing tools for e-commerce, real estate listings, social networking, and peer-to-peer taxi services in Cambodia.
We are a venue, not a participant. We do not own the real estate listed, we do not employ the taxi drivers, and we do not manufacture the goods sold. Any contract or transaction initiated through Mayland is strictly between the User (Buyer/Rider) and the Provider (Seller/Driver). Mayland makes no guarantees regarding the quality, safety, or legality of items or services advertised.
4. Acceptable Use Policy (AUP)
To ensure the safety of our community and compliance with our cloud infrastructure providers (including Amazon AWS/SES), you agree NOT to use the Platform to:
- Spam: Send unsolicited promotional messages, junk mail, chain letters, or operate pyramid schemes.
- Fraud: Post fraudulent listings, engage in phishing, or attempt to scam other users.
- Illegal Goods: Sell or promote illegal drugs, weapons, counterfeit goods, stolen property, or any items prohibited by the laws of Cambodia.
- Abuse: Harass, threaten, or defame other users.
- System Interference: Introduce viruses, malicious code, or attempt to bypass the platform's security mechanisms.
Violations of this AUP will result in immediate account termination and potential reporting to local law enforcement.
5. User-Generated Content (UGC) Policy
In accordance with Apple App Store and Google Play guidelines, Mayland maintains a zero-tolerance policy for objectionable content.
- Content Responsibility: You retain ownership of the photos, listings, and text you post, but you grant Mayland a non-exclusive license to display this content on the Platform.
- Prohibited Content: You may not post content that is violent, explicit, sexually suggestive, discriminatory, or infringes on the copyright of others.
- Community Moderation: Users are empowered to flag and block abusive content or users. Mayland administrators will review flagged content within 24 hours and remove violating materials.
6. Community Taxi Services
For users utilizing the Mayland Taxi routing features:
- Independent Contractors: Drivers on the Mayland platform are independent individuals, not employees or agents of Sysmay Cambodia.
- Assumption of Risk: Riders assume all risks associated with arranging transport through a peer-to-peer network. We strongly encourage users to check driver Trust Points and reviews before accepting rides.
7. Payments and Transactions
- Zero Platform Fees: Mayland does not charge commission fees, subscription fees, or processing fees for listings or rides.
- Peer-to-Peer Settlement: All financial transactions (e.g., paying for a product or a taxi ride) are conducted directly between the buyer and seller using external methods, such as Cash, KHQR, Bakong, or local bank transfers. Mayland does not process, hold, or guarantee user funds.
8. Intellectual Property
The Mayland platform, including its original code, design, layout, and brand logos, are the exclusive property of Sysmay Cambodia and are protected by international copyright and trademark laws. You may not duplicate, copy, or reuse any portion of our visual design elements or code without express written permission.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAYLAND AND SYSMAY CAMBODIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Platform.
- Any conduct or content of any third party on the Platform, including defamatory, offensive, or illegal conduct.
- Transactions, meetings, or rides arranged through the Platform.
- Unauthorized access, use, or alteration of your transmissions or content.
THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
10. Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if you violate these Terms, the Acceptable Use Policy, or engage in conduct that harms the Mayland community. You may also terminate this agreement at any time by deleting your account and discontinuing use of the Platform.
11. Governing Law & Contact
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia, without regard to its conflict of law provisions.
